Welcome to Thinklar. These Terms & Conditions (“Terms”) govern your use of our website, SaaS platforms, AI tools, software solutions, and all services provided by Thinklar (“we,” “our,” “us”).

By accessing or using our website or services, you agree to comply with these Terms. If you do not agree, please stop using our services.

1. Definitions

  • “Services” means all SaaS platforms, AI tools, products, and custom software development offered by Thinklar.

  • “Client”, “User,” “You” refers to any individual or business using our services.

  • “Platform” refers to Thinklar’s SaaS systems, dashboards, websites, applications, and APIs.

  • “Content” refers to all material uploaded, submitted, or processed through our platform.

2. Use of Services

By using our services, you agree that:

  • You will comply with all applicable laws.

  • You will not misuse or abuse the platform.

  • You are responsible for maintaining the confidentiality of your account credentials.

  • You will provide accurate and truthful information.

You are responsible for all activities that occur under your account.

3. Eligibility

You must be at least 18 years old or the legal age of majority in your region to use our services.

4. Account Registration

When you create an account:

  • You must provide accurate information.

  • You are responsible for safeguarding your login details.

  • You must notify us of any unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms.

5. SaaS Platform Usage

If you use Thinklar’s SaaS products:

  • Subscription fees apply as per your selected plan.

  • You may not share or resell your account access.

  • Resource usage must remain within fair use limits (API calls, storage, messaging, etc.).

  • We may update, modify, or improve features without prior notice.

6. AI Tools and Automation Services

When using Thinklar AI services:

  • You retain ownership of your input content.

  • AI-generated output may not always be accurate, and you are responsible for verifying results.

  • You may not use the AI system for harmful, illegal, or unethical activities.

  • We may log anonymized data to improve models unless otherwise stated.

7. Custom Software Development

For custom software development:

  • Project timelines are estimates.

  • Requirements must be clearly communicated.

  • Additional requests outside scope may incur extra charges.

  • Final delivery will follow mutually agreed documentation and milestones.

  • Thinklar may showcase completed work in its portfolio unless the client requests confidentiality.

8. Payment, Billing & Refunds

a. SaaS Subscriptions

  • Fees are charged monthly or annually.

  • All payments are non-refundable unless required by law.

  • Cancellation stops future billing but does not refund past payments.

b. Custom Projects

  • Payments may follow milestones or full advance.

  • Work begins only after initial confirmation payment.

  • No refunds are provided for completed milestones or delivered work.

9. Intellectual Property

a. Client IP

You own the data, files, and content you upload.

b. Thinklar IP

We own:

  • Source code

  • Designs

  • Algorithms

  • AI models

  • Frameworks

  • Documentation

  • Branding and trademarks

Clients receive a license to use delivered software or services, not ownership of underlying core frameworks unless agreed separately.

10. Prohibited Activities

You agree NOT to:

  • Use the platform for illegal or fraudulent activities.

  • Spread malware, phishing, or harmful content.

  • Reverse engineer or copy our systems.

  • Attempt unauthorized access to servers, APIs, or databases.

  • Misuse any feature intended for communication or automation.

Violation may result in immediate suspension.

11. Data Privacy & Security

Your data is handled as per our Privacy Policy.
We follow industry-standard practices but cannot guarantee 100% security.

You are responsible for securing your devices and network.

12. Availability & Service Downtime

We strive for high uptime, but:

  • Maintenance, upgrades, or external factors may cause downtime.

  • We are not liable for losses arising from service interruptions.

13. Limitation of Liability

To the fullest extent permitted by law:

  • Thinklar is not liable for indirect, incidental, or consequential damages.

  • Total liability is limited to the amount paid for the last 3 months of service.

  • All AI-generated content is provided “as is” and must be verified by you.

14. Termination

We may suspend or terminate your account if:

  • You violate these Terms

  • You misuse the platform

  • Required by law

  • Non-payment of fees

You may terminate your subscription anytime through your account or by contacting support.

15. External Links & Third-Party Integrations

We may integrate with third-party APIs such as:

  • Payment gateways

  • Cloud services

  • Marketing tools

  • AI providers

We are not responsible for their policies or actions.

 

16. Changes to Terms

We may update these Terms at any time.
Continued use of our services means you accept the changes.
